BEFORE USING THIS SOFTWARE, PLEASE READ THE FOLLOWING AGREEMENT CAREFULLY. YOU AGREE TO THESE TERMS AND CONDITIONS BY USING THE SOFTWARE. DO NOT USE THE SOFTWARE IF YOU DO NOT AGREE TO THESE TERMS.

DEFINITION: The User must read and understand this agreement before agreeing to the terms and conditions that include the terms of service and the following information regarding usage and participation in hitshot.in. These terms must be fully comprehended and strictly adhered to by its users.

The Terms of Use agreement between Swifttrick Technologies, its subsidiaries, and the Website's players, www.hitshot.in. Hereon in, Swifttrick Technologies and its subsidiaries are referred to as "we", "us", "our" and other such pronouns. The Website, www.hitshot.in shall be referred to as the "website", "site" or "platform". And the players shall be referred to as "you", "your", or "user".

INTELLECTUAL PROPERTY

Swifttrick Technologies holds all rights tangible or intangible for the Website and all the services offered on the Website, including but not limited to all games and other content, promotional material, inter alia all strategic and development plans, ideas, designs, financial conditions, business plans, data banks, information related to technology and process, the technology developed including the software and methodology of usage from here on referred to as "Intellectual Property". The company only permits the User to use the Intellectual property to play the games and use other services offered. Under all circumstances, the User is strictly prohibited from using the intellectual capital otherwise, which includes but is not limited to copying, reproducing or transmitting any media known to/or will be known to humankind of the intellectual property. The User is not being granted any rights whatsoever with respect to intellectual property by allowing him to play games on the Website and use other services on the Website. Except as expressly authorized by www.hitshot.in, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Site, in whole or in part.

THIRD-PARTY SITES, SERVICES AND PRODUCTS

Swifttrick Technologies may contain links to other Internet sites owned and operated by third parties. User's use of each of those sites is subject to the conditions, if any, posted by the sites. Swifttrick Technologies does not exercise control over any Internet sites apart from Swifttrick Technologies and cannot be held responsible for any content residing in any third-party Internet site. Swifttrick Technologies inclusion of third-party content or links to third-party Internet sites is not an endorsement by Swifttrick Technologies of such third-party Internet site. User's correspondence, transactions/offers or related activities with third parties, including payment providers and verification service providers, are solely between the User and that third party. User's correspondence, transactions, and usage of the services/offers of such third party shall be subject to the terms and conditions, policies and other service terms adopted/implemented by such third party, and the User shall be solely responsible for reviewing the same prior to transacting or availing of the services/offers of such third party. User agrees that Swifttrick Technologies will not be responsible or liable for any loss or damage of any sort incurred as a result of any such transactions/offers with third parties. Any questions, complaints, or claims related to any third-party product or service should be directed to the appropriate vendor. Swifttrick Technologies contains content that is created by Swifttrick Technologies as well as content provided by third parties. Swifttrick Technologies does not guarantee the accuracy, integrity, quality of the content provided by third parties and such content may not be relied upon by the Users in utilizing the Swifttrick Technologies services provided on Swifttrick Technologies, including while participating in any of the contests hosted on Swifttrick Technologies.

PRIVACY POLICY

All information collected from Users, such as registration and all payment information, is subject to Swifttrick Technologies Privacy Policy which is available at Privacy & Policy.

USAGE OF Swifttrick Technologies

• An individual using the services offered by Swifttrick Technologies or the Swifttrick Technologies App including the Fun Features offered, by participating in various contests and games (including online fantasy sports gaming), organized on the Swifttrick Technologies platform ("Contest(s)") are bound to follow these Terms and Conditions, and all other rules, regulations, and terms of use defined by the Swifttrick Technologies authorities.
• Various services offered as a part of fun features by Swifttrick Technologies might be associated with additional rules and regulations formulated in that respect. If the Terms and Conditions are inconsistent with the additional conditions formulated, the additional conditions shall control.
• Swifttrick Technologies may, at its sole and absolute discretion:
• Restrict, suspend, or terminate any User's access to all or any part of hitshot.in
• Change, suspend, or discontinue all or any part of the Fun Features;
• Deactivate or delete a User's account and all related information and files on the account;
• Reject, move, or remove any material that a User may submit;

Swifttrick Technologies holds all the rights to restrict, suspend or terminate a user's access to all or any part of hitshot.in or the fun features provided by Swifttrick Technologies, deactivate or delete a user account and information, delete user content without any prior notice to the User if any user is found or believed to be breaching the Terms and Conditions defined by Swifttrick Technologies or using hitshot.in or the fun features provided by Swifttrick Technologies illegally or inappropriately. Further, Swifttrick Technologies is authorized to take any technical or legal action against the User if necessary.

CONDITIONS OF PARTICIPATION

• By entering a Contest, the User agrees to be bound by these Terms and the decisions for Swifttrick Technologies. Subject to the terms and conditions stipulated hereinbelow, the company, at its sole discretion, may disqualify any user from a Contest, refuse to award benefits and require the return of any cash if the User engages in unfair conduct, which the company deems to be improper, unfair or otherwise adverse to the operation of the Contest or is in any way detrimental to other Users which includes, but is not limited to:
• Falsifying one's personal information (including, but not limited to, name, email address, bank account details and/or any other information or documentation as may be requested by Swifttrick Technologies to enter a contest and/or claim a winning.;
• Engaging in any type of financial fraud or misrepresentation, including unauthorized use of credit/debit instruments, payment wallet accounts, etc., to enter a Contest or claim a win. It is expressly clarified that the onus to prove otherwise shall solely lie on the User.
• Colluding with any other user(s) or engaging in any type of syndicate play;
• Any violation of Contest rules or the Terms of Use;
• Accumulating points or cash through unauthorized methods such as automated bots or other automated means;
• Using automated means (including but not limited to harvesting bots, robots, parser, spiders or screen scrapers) to obtain, collect or access any information on the Website or of any User for any purpose
• Tampering with the administration of a Contest or trying to in any way tamper with the computer programs or any security measure associated with a Contest;
• Obtaining other users information without their express consent and/or knowledge and/or spamming other users (Spamming may include but shall not be limited to send unsolicited emails to users, sending bulk emails to Swifttrick Technologies users, sending unwarranted email content either to selected Users or in bulk); or
• Abusing the Website in any way ('unparliamentary language, slangs or disrespectful words' are some of the examples of Abuse)
• It is clarified that in case a User is found to violate this policy, Swifttrick Technologies reserves its right to initiate appropriate Civil/Criminal remedies as it may be advised other than forfeiture and/or recovery of money if any.

REGISTRATION

The individuals wishing to use the services, Fun Features and participate in the contest(s) organized by hitshot need to complete the registration process of hitshot.in.

Hitshot The registration process requires the user to submit and verify certain documents to provide personal and contact information to the hitshot platform. The documents required for creating and registering an account with hitshot include:

• ID
• Email
• Mobile Number
• Password
• Date of birth

PLAY FORMATS

Swifttrick Technologies Offers its services, Contest (s) or fun feature(s) under two types of Play Formats, namely, Regular Play and Safe Play, respectively. The Regular Play option of Swifttrick Technologies comprises leagues wherein the User is allowed to create or edit his/her teams and participate in the game complying with a deadline of 1-hour prior to the start of real-match in cricket.

The Safe Play feature of Swifttrick Technologies, on the other hand, benefits the users participating or availing of the services, Contest (s) or fun feature(s) provided by Swifttrick Technologies, with extended deadlines. The users participating in leagues under the Safe Play option can create or edit their teams until the last moment, i.e., right before the beginning of the real match.

LEGALITY OF GAME OF SKILL

• Games of skill are legal, as they are excluded from the ambit of Indian gambling legislations including, the Public Gambling Act of 1867. In 2020, dismissing a Public Interest Litigation (PIL) filed by Ravindra Singh Chaudhary, the Rajasthan High Court has held that the question of whether playing fantasy sports amounts to gambling is no longer res Integra or undecided in law. As a game of skill, where users can pay a fee to compete and win, fantasy sports platforms are legitimate businesses protected by Article 19(1)(g) of the Indian Constitution, which guarantees the right to carry on any occupation, trade or business.
• The Contest (s) described above (across the Fun Features) are games of skill as the success of Participants depends primarily on their superior knowledge of the games of cricket knowledge of players' relative form, players' performance in a particular territory, conditions and/or format (such as ODIs, test cricket and Twenty20 in the online cricket fantasy gaming), attention and dedication towards the Contest (s) and adroitness in playing the Contest (s). The Contest (s) also requires Participants to field well-balanced sides with limited resources and make substitutions at appropriate times to gain the maximum points.
• By participating in this Contest (s), each Participant acknowledges and agrees that he/she is participating in a game of skill.
• More about the legality of Swifttrick Technologies can be found at the Indian Federation of Sports Gaming (IFSG): IFSG is recognized as India's first and only self-regulatory sports gaming authority focusing on developing standardized practices in the industry.

WINNERS SELECTION VERIFICATION & WIN CONDITIONS

Winners will be decided on the basis of the scores of the Teams in a designated round (which may last anywhere between one day and an entire tournament) of the Contest (s). The Participant (s) owning the Team(s) with the highest aggregate score in a particular round shall be declared the Winner (s). In certain pre-specified Contests, hitshot may declare more than one Winner and distribute cash to such Winners in increasing order of their Team's aggregate score at the end of the designated round of the Contest. The contemplated number of Winners and the cash due to each Winner in such Contest shall be as specified on the Contest page prior to the commencement of the Contest. Participants creating Teams on behalf of any other Participant or person shall be disqualified. In the event of a tie, the winning Participants shall be declared Winners and the cash shall be equally divided among such Participants. hitshot shall not be liable to pay any cash if it is discovered that the Winner (s) did not abide by these Terms and Conditions.

GADGET LEAGUES WINNERS:

• Anyone who wins a cash in Gadget League will need to deposit 31.2% TDS (as per government norms) of the gift amount in bank account.
• The User will need to ask for the bank account details.
• You need to share the screenshot of the deposit with us over email.
• If anyone fails to deposit the amount or share the screenshot in seven days, then we will withdraw the offer.

CONTACTING WINNERS:

Winners shall be contacted by hitshot or the third party conducting the Contest on the email address provided at the time of registration. The verification process and the documents required for the collection of the cash shall be detailed to the Winners at this stage. As a general practice, winners will be required to provide the following documents:

• PAN card copy
• Copy of proof of Residence
• Bank account details with proof

Hitshot shall not permit a Winner to withdraw his/her win/accumulated winnings unless the above-mentioned documents have been received and verified within the time period stipulated by hitshot. The User represents and warrants that the documents provided in the verification process are true copies of the original documents to which they relate.

Participants are required to provide proper and complete details at the time of registration. Hitshot shall not be responsible for communications errors, commissions or omissions, including those of the Participants due to which the results may not be communicated to the Winner.

The list of Winners shall be posted on a separate webpage on www.hitshot.in. The winners will also be intimated by email. In the event that a Participant has been declared a Winner on the above-mentioned webpage but has not received any communication from hitshot, such Participant may contact hitshot within the time specified on the webpage.

VERIFICATION PROCESS:

Only those Winners who successfully complete the verification process and provide the required documents within the time limit specified by hitshot shall be permitted to withdraw/receive their accumulated winnings (or any part thereof). Hitshot shall not entertain any claims or requests for extension of time for submission of documents. hitshot shall scrutinize all documents submitted and may, at its sole and absolute discretion, disqualify any Winner from withdrawing his accumulated winnings (or any part thereof) on the following grounds: Determination by hitshot that any document or information submitted by the Participant is incorrect, misleading, false, fabricated, incomplete or illegible; or Participant does not fulfil the Eligibility Criteria specified

TAXES PAYABLE:

All cash shall be subject to a tax deduction ("TDS") as per the Income Tax Act 1961. Winners will be provided TDS certificates in respect of such tax deductions. The Winners shall be responsible for payment of any other applicable tax, including but not limited to income tax, gift tax, etc., in respect of the cash money.

MISCELLANEOUS

The decision of hitshot with respect to the awarding of cash shall be final, binding and non-contestable. Participants playing the Contest (s) paid formats to confirm that they are not residents of any of the following Indian states – Arunachal Pradesh, Assam, Odisha, Sikkim, Nagaland, Andhra Pradesh, Telangana. If it is found that a Participant playing the paid formats of the Contest (s) is a resident of any of the above-mentioned states, hitshot shall disqualify such Participant and forfeit any cash won by such Participant. Further hitshot may, at its sole and absolute discretion, suspend or terminate such Participant's account with www.hitshot.in. Any amount remaining unused in the User's Game Account or Winnings Account on the date of deactivation or deletion shall be reimbursed to the User by an online transfer to the User's bank account on record with hitshot, subject to the processing fee (if any) applicable on such transfers as set out herein.

If it is found that a Participant playing the paid formats of the Contest (s) is under the age of eighteen (18), hitshot shall be entitled, at its sole and absolute discretion, to disqualify such Participant and forfeit his/her cash. Further, hitshot may suspend or terminate such Participant's account at its sole and absolute discretion. To the extent permitted by law, hitshot makes no representations or warranties as to the quality, suitability or merchantability of any cash and shall not be liable in respect of the same.

Hitshot may, at its sole and absolute discretion, vary or modify the cash being offered to winners. Participants shall not raise any claim against hitshot or question its right to modify such cash being offered prior to the Contest's closure.

Hitshot will not bear any responsibility for the transportation or packaging of cash to the respective winners. hitshot shall not be held liable for any loss or damage caused to any cash at the time of such transportation. The Winners shall bear the shipping, courier or any other delivery cost in respect of the cash.

The Winners shall bear all transaction charges levied for delivery of cash. All cash are non-transferable and non-refundable. Win cannot be exchanged/redeemed for cash or kind. No cash claims can be made in lieu of cash in kind.

PUBLICITY

Acceptance of a cash by the Winner constitutes permission for Swifttrick Technologies and its affiliates to use the Winner's name, likeness, voice and comments for advertising and promotional purposes in any media worldwide for purposes of advertising and trade without any further permissions or consents and/or additional compensation whatsoever. The Winners further undertake that they will be available for promotional purposes as planned and desired by Swifttrick Technologies without any charge. The exact dates remain the sole discretion of Swifttrick Technologies. Promotional activities may include but not be limited to press events, internal meetings, and ceremonies/functions.

GENERAL CONDITIONS

In a rare event wherein Swifttrick Technologies identifies the need of any governmental, statutory or regulatory compliances or approvals for organizing any Contest(s) or the company identifies any ongoing Contest(s) breaching the legal guidelines or being prohibited by the legal authorities, then, Swifttrick Technologies holds all the rights to cancel or withdraw such Contest (s) without any prior notice to the participants or the winners. The individuals using the services provided by Swifttrick Technologies agree not to make any claims related to such cancellation or withdrawal in any manner. The employees, directors, affiliates, relatives and family members of Swifttrick Technologies will not be eligible to participate in any Contest(s).

VERIFICATION

• In order to create, register and operate an account with Swifttrick Technologies, the users need to verify personal and contact information, including (i) Mobile Number, (ii) Email Address, (iii) Pan Card Details; and (iv) Bank Account Details such as Name, Bank Name, DOB, Branch, IFSC Code, State.
• The images provided by the individuals using the services and Fun Features provided by Swifttrick Technologies should be scanned copies of the original documents. Further, the image size of the scanned copies of original documents provided by the users for account verification should not exceed 2MB.
• By accepting these Terms and Conditions, the users provide their consent to provide adequate and accurate information at verification. Swifttrick Technologies reserves all the rights to reject a user's verification application in an event wherein the User's PAN card details and Account details do not match each other.
• The users using the services provided by Swifttrick Technologies should provide the documents demanded by Swifttrick Technologies; none of the document alternatives would be accepted for the verification process. Further, the PAN card of a user creating and registering an account with Swifttrick Technologies born before the year 1968 will not be accepted. In an event wherein the User creating and registering an account with Swifttrick Technologies is born before the year 1968, the User will be required to provide a verification prof wherein the User should email an image holding his/her PAN card near his/her face at (website links)
• The verification process of Swifttrick Technologies needs 1-3 days for completion. In this regard, all the verification requests can take up to 1-3 working days to complete. Swifttrick Technologies will update the users regarding the completion of the verification process.
• Any change in the information provided by the User while registration or after should only be entertained if received in writing with a valid document of change. Users are bound to provide the change in their information to Swifttrick Technologies for updating their records in the system. If the User fails to provide the same, the User shall be held solely responsible for failure in receiving communication updates from Swifttrick Technologies.

SECURITY PROTOCOL

Every data & user information collected & gathered by hitshot are securely stored in hitshot servers. Our servers are firewall protected & are equipped with all modern security facilities for data prevention & protection. Even with all the security measurements, it is impossible to claim that any security system is impenetrable or inaccessible. Thus hitshot will not guarantee any data transmitted over the internet, which can easily be encrypted or attached to malicious programs during transmission. With this ever-changing internet structure, hitshot is likely to keep on updating its privacy policies. Any such change will be immediately informed to our users so as to maintain transparency. Several bogus promotions, blogs, and emails may rotate over the internet with our logo, pictures, links & other information. Their main perspective is to leverage or extract user information or money from the User, luring them with cash . Hitshot highly recommends that its users not respond to these bogus sources & also would like to establish that we are by no means related or associated with such activities. Hitshot will not be responsible if the User falls into such a trap.

ADVERTISEMENTS

To help understand our User base and decide upon the value of advertising on the Portal hitshot, it presents aggregated statistics to its online advertisers. After Users registration, we contact our Users from time to time to provide features, which we believe may benefit our Users. Anyone can receive Several deceptive emails, websites, blogs etc., claiming to be one of us from hitshot. These Websites, emails, blogs etc., may include our logo, photos, links, content or other information—some emails, websites, blogs etc. You can even call the User to provide a login name, password etc. We strongly recommend not responding to any of these for your own protection.

PAYMENT CANCELATION TERMS

Participated player/user with submitted amount cannot withdraw the amount if any contest/match is cancelled due to unconditional reasons; the submitted amount will be transferred to participant's/user's Wallet and can use this amount for upcoming contests/matches. The amount can be withdrawn if and only if the Participant WIN the Contest, and Only the Winning Amount can be withdrawn, which needs to be added on the hyperlink of an unconditional label.
